RESUMEN

El presente trabajo analiza el nuevo Pacto sobre Migración y Asilo de la Unión Europea y el impacto que este tiene sobre las ONG catalanas que atienden a personas solicitantes de asilo o trabajan en torno al asilo. Asimismo, también se centra en las posibles alternativas propuestas por las propias ONG entrevistadas y sus respectivas perspectivas de futuro. Para facilitar el entendimiento completo del análisis, hay una investigación previa del concepto y evolución del derecho de asilo y una breve descripción de las actuales ONG que trabajan en este campo. La intención de este trabajo es comprender una nueva normativa que será de pronta aplicación en los países de la Unión Europea. Así pues uno de los principales objetivos del trabajo es indagar si la nueva legislación supondrá mejoras respecto a la situación actual de las personas refugiadas, o por el contrario les afectará negativamente. La metodología utilizada para alcanzar los objetivos del trabajo se ha basado en la investigación bibliográfica, así como en el análisis jurídico-social y de contenido de una normativa en materia de migración y asilo. También se ha procedido a la realización de diversas entrevistas en profundidad a personas que trabajan en ONG dedicadas a atender a personas solicitantes de asilo (como No One Is Illegal y CCAR) a una investigadora predoctoral en Filosofía del Derecho y a un eurodiputado del Partido Socialista Obrero Español (PSOE) en el Parlamento Europeo (Juan Fernando López Aguilar). Los resultados del análisis han revelado la verdadera intención de la Unión Europea que se esconde detrás de su discurso. Debido a la falta de transparencia que rodea al Pacto, no se está dejando margen de actuación a las ONG, generándose una grave inquietud en las personas solicitantes de asilo y en las organizaciones que trabajan con ellas.

ABSTRACT

This project analyzes the European Union's new Pact on Migration and Asylum and its impact on Catalan NGOs serving asylum seekers or working in the field. It also focuses on the possible alternatives proposed by the interviewed NGOs and their respective future perspectives. To facilitate a complete understanding of the analysis, there is a preliminary investigation into the concept and evolution of the right to asylum and a brief description of the current NGOs working in this field. The purpose of this paper is to understand a new regulation that will soon be implemented in the countries of the European Union. Therefore, one of the main objectives of this paper is to investigate whether the new legislation will improve the current situation of refugees or, on the contrary, negatively affect them. The methodology used to achieve the objectives of this paper was based on bibliographic research, as well as a legal-social and content analysis of regulations on migration and asylum. Several in-depth interviews were also conducted with individuals working for NGOs dedicated to assisting asylum seekers (such as No One Is Illegal and CCAR), with a predoctoral researcher in Philosophy of Law and to an MEP from the Spanish PSOE in the European Parliament (Juan Fernando López Aguilar). The results of the analysis have revealed the true intentions of the European Union behind its rhetoric. Due to the lack of transparency surrounding the Pact, NGOs are being left with little room to maneuver, generating serious concern among asylum seekers and the organizations that work with them.
